Pot candy found in car involved in fatal wreck, search warrant says

New details released in a search warrant show that candy bars laced with pot were found in the car of a teenager accused of killing a Pismo Beach woman.

When investigators from the District Attorney’s Office searched the Audi sedan driven by Alex Forster in a head-on crash that killed Francheska Rubin on June 13, they found “two unusual appearing candy bars,” according to a search warrant filed in the case.

“The bars appeared to be chocolate and were wrapped in black foil which was sealed with transparent tape,” the warrant stated.

The candy later tested positive for tetrahydrocannabinol, main active chemical in marijuana more commonly called THC, according to the warrant.

Investigators also found three water smoking pipes and a transparent baggie of what appeared to be marijuana. Forster, 18, is facing felony vehicular manslaughter and misdemeanor marijuana possession in connection with the crash. He has pleaded not guilty to the charges.

The teen was driving east on Price Canyon Road about 5 p.m. on June 13 when he slammed his car head-on into a Toyota Avalon driven by 58-year-old Rubin, according to the California Highway Patrol.

After the crash, Forster allegedly tested positive for marijuana and was booked into the San Luis Obispo County Jail before posting $50,000 bail, according to court records.

He is scheduled to return to San Luis Obispo Superior Court on Sept. 24, according to prosecutors.

Prosecutors waited about two months to file charges in the case because they said they needed to do more investigation and interviews and were waiting for evidence to be analyzed, Assistant District Attorney Dan Hilford said.

New details released in the search warrant showed that investigators found photos in an iPod media player found in the Audi of people using “a smoking device commonly identified as drug paraphernalia.”

A person who saw the crash told investigators she saw Forster drifting over the road’s double-yellow center lines. A person driving behind Forster for several miles said that he was concerned about the Audi because it was moving erratically, according to the search warrant.

“He described the Audi as drifting within the eastbound lane, crossing the painted lines, intermittently slowing and accelerating and tailgating the vehicle in front of him to within … inches,” the search warrant stated. “He distanced himself anticipating a collision.”
